Mündliche Prüfungen aus Bürgerlichem Recht

Bei mündlichen Prüfungen müssen alle KandidatInnen zu Beginn eine Nummer ziehen, die jenen Fragenkatalog bezeichnet, nach dem die KandidatInnen in der Folge geprüft werden. Wer zu einem späteren Termin als die ersten KandidatInnen bestellt ist, hat demzufolge eine zunehmend reduzierte Auswahl, was aber die Chancen nicht beeinflusst.

Ein solcher Fragenkatalog besteht aus drei Fragen; die erste davon ist ein Fallbeispiel mit fortführenden Fragen. Die zweite Frage ist eine Theoriefrage; die dritte dient als Zusatzfrage in Zweifelsfällen. Die Fragen gehen quer durch den gesamten Prüfungsstoff, wobei die drei Fragen in der Regel aus jeweils anderen Teilgebieten sind.

Die KandidatInnen werden ausnahmslos nach den Fragen des von ihnen selbst gezogenen Katalogs geprüft; damit bestimmt jede(r) selbst über die Themenbereiche und Schwierigkeitsgrade.

Schriftliche Prüfungen aus Bürgerlichem Recht

Der Fall der schriftlichen Diplomprüfung wird normalerweise gemeinsam mit den/dem anderen Prüfer(n) des jeweiligen Termins erstellt. Stoff ist selbstverständlich immer das gesamte Bürgerliche Recht einschließlich des Internationalen Privatrechts. Die Korrekturen orientieren sich typischerweise nach einem Fallprüfungsschema, an dem die Arbeiten nach der Benotung auch gemessen werden können. Die Benotung erfolgt im Vergleich sämtlicher Arbeiten des jeweiligen Termins, es ist daher schon deshalb unmöglich, vorab irgendwelche Auskünfte über die Note einzelner Arbeiten (einschließlich der kommissionellen Arbeiten) zu geben.
